General Terms and Conditions

 Cooling Off/Cancellation – There is no cooling off period once payment has been taken. All payments are non-refundable.  

 Rescheduling – You acknowledge that HGBB reserves the right to reschedule depending on unforeseen circumstances

Training Sessions / Courses 

Attendance –  HGBB will not refund you any portion of the Course Fee whether you attend or not. Online courses are recorded for  future reference.

Disclaimer

Suitability of Services – To the maximum extent permitted by Law You acknowledge and agree that:

(i)      HGBB does not warrant or guarantee any outcomes, or the suitability of the courses, for any purpose

(ii)     You understand that Shamanic Healing, Sound Healing, Crystal Healing or any other therapy or training provided by HGBB or their staff and/or representatives is not a replacement for medical treatment, including but not limited to, psychological or psychiatric services or the appropriate counselling.  You also understand that Eloys Harradence does not treat, prescribe for, or diagnose any condition. 

You declare that, if You have any concerns about your ability to attend this event you will seek appropriate medical/psychological approval prior to attending this workshop. 

If you have any medical/psychological conditions that affect your ability to take full responsibility for your emotional and psychological health   please contact eloise@healinggroundsbyronbay prior to enrolling the workshop or event

(iii)    You indemnify HGBB from and against any loss or damage arising as a result of your failure to obtain independent psychological or psychiatric advice, in accordance with this clause.

 Release– You acknowledge and agree that HGBB is not liable for and You release HGBB from any and all Claims including but not limited to:

(i)      Any failure, error, omission or interruptions in the availability or quality of the internet, telecommunications systems or other technology used during a Workshop and

(ii)     Any interference, loss or damage to any data, computer system, mobile device or any other property arising as a result of or in connection with the provision of the Workshop; and

(iii)    Any reliance on any information, document, advice or other material(s) by HGBB in connection with the Workshop or on its website.

 Exclusion of Liability – To the Maximum extent permitted by Law, You agree that HGBB will not be liable for, and you waive any right you have to claim, any loss of income, production, contract and/or customers

Australian Consumer Law

Nothing in these Terms and Conditions will be construed as excluding, restricting or modifying any Consumer Guarantee contained in the Australian Consumer Law. HGBB’s liability to comply with the Australian Consumer Law is limited, at the sole discretion of HGBB, to supplying the service again or payment of the costs of having the service supplied again.

Intellectual Property and Privacy

 Intellectual Property – You acknowledge and agree that HGBB will retain ownership of all Intellectual Property created as a result of or in connection with the Workshop. You agree not to copy, reproduce, publish or broadcast any of the material contained in the Online and in person services, workshops and events.

 Privacy – Subject to the terms of its Privacy Policy, HGBB will only collect personal information from You for the purpose of providing the Course to the extent permitted by Law, notifying You of other services provided by HGBB and other parties which may be of interest to You (subject to your rights to opt out of such communications); providing information to You which HGBB believes may be useful or relevant to your business having regard to your acquisition of the Course and You.  You give HGBB permission to collect and store any personal details and other information provided by You in connection with the Workshop in accordance with the Privacy Policy.

Confidential Information

HGBB will not disclose your confidential information unless:

(i)      You give your consent to disclose or use of the information

(ii)     The use of disclosure of the information is required by law; or

(iii)    The use of disclosure is required for the purpose of performing the Workshop

Governing Law

These Terms and Conditions are governed by and must be construed in accordance with the Laws of the State of Western Australia.

TERMS and CONDITIONS FOR  IN PERSON WORKSHOPS HELD AT HEALING GROUNDS BYRON BAY

I understand that some parts of the Healing Grounds Workshops and Events may pose a risk to my physical wellbeing. These risks include (but are not restricted to):

• Walking on bush tracks or in the bush (eg. Uneven ground, sloping ground, vegetation)
• Possible exposure to very high temperatures

• Beach swimming or river swimming
  • Possible exposure to weather extremes (eg. Storms and high wind)
  • Exposure to bush animals and insects (eg. Snakes and ticks)

I take full responsibility for my physical wellbeing and safety whilst participating in Healing Grounds Workshops and Events.

If you have any physical disabilities, restrictions or illnesses which may impact on your capacity to complete or cope with these tasks or demands, please outline these in an email to Eloys Harradence at [email protected]

I am aware that participation as a student of Healing Grounds it is a deeply spiritual and emotional experience. I acknowledge that the facilitators are not Counsellors or Psychologists and that Healing Grounds Byron Bay facilitators have no intention or claim to providing psychological counselling or therapy or treatment.

I acknowledge that the personal work in the workshops or events may involve remembering past experiences that may have been traumatic and deep reflecting on my psychological and emotional world.

I accept full responsibility for any responses that I have to this work and agree that I will notify HGBB of any adverse concerns and seek my own therapy treatment as needed separately from the workshops.

I confirm that I have the capacities to cope with the psychological and emotional demands of Healing Grounds Workshops and Events. I take full responsibility for my psychological and emotional wellbeing whilst I am undertaking the work.

 If you have a history of psychological or emotional health issues, particularly if you are undergoing current treatment (eg. counselling, psychotherapy or medication) for this, please indicate this to us. A teacher from HGBB will be in contact with you to discuss further.

I understand and agree that confidentiality of private information revealed to me by other participants of the workshops is critical. I agree to keep this confidentiality and understand that it will also be kept for me.

HGBB always keeps personal information, including that provided in written applications and other documents confidential.  

I hereby waive, release and discharge the HGBB, Eloys Harradence and its’ facilitators and their heirs, legal representatives, administrators and executors, for all liability for or by reason of any damage, loss or injury (including death) to myself, or my property which has been or may be sustained as a result of my participation in the HGBB activities; and not withstanding that such damage, loss or injury may have been caused solely or partly by HGBB or its’ Facilitators negligence.

 I acknowledge that I have read this agreement and waiver and agree that by participating in HGBB workshops I knowingly and freely assume all possible risks as outlined in this agreement and those risks that may not be known and outlined in this agreement: even if these risks arise from the negligence of HGBB, its’ facilitators, or other people participating in the workshops and events. I assume full responsibility for my participation.

I consent to administration of first aid and other medical treatment in the event of injury or illness and hereby release and indemnify HGBB it’s facilitators and other attendees of the events and workshops from any and all claims arising out of such treatment.

I confirm that this agreement and waiver restricts me from suing or otherwise claiming against the HGBB, its’ Facilitators, and other participants, presently or at any future time, for damage, loss or injury that may occur to myself, or my property as a result of participating in the workshops and events of HGBB.

I understand that this agreement and waiver is being delivered in, and shall be governed, construed, enforced and interpreted by, through and under, the laws of Australia, excluding conflict of law principles that would cause the application of laws of another jurisdiction.

I consent/do not consent to photographs and videos being taken of me whilst participating in the workshops and events.
